Mixed use buildings with office and retail space have become the latest trend in commercial developments. Both office and retail tenants are finding themselves sharing the overall common area cost in a building. This advanced class is designed to introduce the attendee to mixed use buildings and how common area costs are allocated between the different types of tenants. It will also show the attendee the reasons why mixed use buildings have become so popular as well as the challenges the landlord faces in allocating these costs accurately to each tenant. Lastly, this class will address several areas of potential overcharges and misallocations by the landlord that both office and retail tenants should be aware of when reviewing their CAM or operating statement, and how the differences in their leases can affect each other.

This intermediate course will help those involved in lease administration understand what lenders and landlords are trying to achieve with these documents and how to avoid an inadvertent agreement to modify a lease. The use of examples will help attendees learn the due diligence process that some retailers follow prior to execution of the documents.
