This intermediate course for attorneys, as well as seasoned paralegals and lease administrators, will be broken down into two parts. The first will discuss the rules of interpretation used by courts and the second will take a look at examples from actual court decisions where difficult lease language was interpreted, frequently in ways you may not have predicted. When it comes to interpreting leases, it is not what anyone meant to put into the lease that counts; it’s what they actually put into the lease that counts. This course describes how courts look at lease language and shows how you can apply the same rules of interpretation to resolve difficult lease disputes. For example, what is the meaning of the phrase, “including, but not limited to?”, what is the meaning of a covenant without a remedy?, or a description of services to be charged that may or may not be complete?
